    6.     For Rent By Owners.  Investors who own single-family or small multifamily units are an amazing source of new listings for you.  This is one of the easiest scripts to learn and polish because it's a simple business conversation.  If the home is vacant and for rent, might the owner rather sell it versus continue to keep it as a rental?  Offer to do a free, comparative market analysis so they can make an educated decision and see what that does to their plans.  Again, potentially one contact and multiple transactions.  Maybe they want to re-invest in different properties with you.  Maybe they want to cash out their entire portfolio while prices are high.  You won't know if you don't ask.  You'll also love this source because the phone numbers are easy to get!

    7.     Small and medium-sized builders who are building homes on 'spec.'  This means they're speculating that the house will sell.  There are many iterations of this, all of which we teach in Premier Coaching, but what is working for our clients lately is to identify buildable lots and take them to the small builder.  You sell the lot and list the spec home, often bringing the buyer as well.
    8.     Flippers.   Sure, they might sell the home on their own (refer to the previous For Sale By Owner point), but flippers often will list with you so you can bring a buyer to them before they're actually finished with the flip.  This helps them because they can flip more homes in less time.  A bird in hand, so to speak.  Meanwhile, while you have it listed and they're finishing it, the house generates more and more buyer and seller business for you.  It's a win-win for everyone.

    9.     Probate.  Not many agents prospect probate leads because they don't understand it.  Probate is simply the process of selling a home after someone passes away.  The court appoints an executor of the estate who can then sell the property.  If keeping the home in the family is not an option and the executor(s) wish to cash it out, that's a listing.  Sometimes they'll re-invest the proceeds in real estate, sometimes it's just the listing that you'll sell.  Either way, they need someone caring and competent to get the job done.
    10.     Your professional Center of Influence.   When was the last time your favorite lender sent you leads?  When have you asked?  Who do they know who is getting pre-qualified right now to buy and has a home to sell?  Stagers are also great to know because smart sellers call a stager first.  Refer business to stagers and ask for leads in exchange.

    1.     Your past clients and sphere of influence.  Otherwise known as your database, statistically, when you have regular and real conversations with your list, 10% of your list will either do business with you or refer business to you every year.  What would happen if you committed to speaking with 100% of the people in your database this quarter?  (Don’t get mad when another agent lists 'your' past client if you're not making the effort!)

    Take it from coaching client Patrick Murphy in Columbus, Ohio:
    I have about 125 clients from over the last three years. After listening to you and Tim mention a few times that those would be the best calls to make… I put serious effort into this a couple of weeks ago. I simply created a Google sheet with all the clients listed out and then a way to track each as I made contact. This is not a text or email (as I usually do with my clientele) but a phone call!
    These are the best calls to make. They actually want to hear from you. They're happy to hear from you, and they share information and leads WAY more than they would've had via text or replying to an email. I'm learning about job changes, family changes, etc. 
    Just today, a client mentioned he's ready to start looking at investment properties. I'm not sure if he would have reached out to me to tell me that!
    I try to bring some value to the call in terms of helping with any contractor connections or getting them up-to-date home valuations, but honestly, I don't think they're looking for too much more than just catching up
    If you think about it, we spent at least 5 to 6 weeks together and built a relationship, so it's very natural for this group to chat with me.

    `4 Rules To Follow to Be Successful Earning at least $100k in 100 Days:
    The average sale price in the United States is currently $412,000, which makes the average commission about $12,000. After 20% of expenses ($9600 net per deal), you need 10 deals to make $100,000 in 100 days. Everyone listening to this podcast can 100% accomplish this goal, assuming they follow the plan.

    Note: If your average sale price is closer to $ 1 million, then you only need 5 deals to make $100k in the next 100 days. Adjust accordingly.
    Once you've done this the first time, you'll then 'lather, rinse and repeat'!
    There will absolutely be an influx of people buying or selling real estate in the next 100 days. We know this based on increasing mortgage applications and increasing inventory for sale. The only question is whether YOU will be the one to list (or sell) the next homes in your market! 
    Decide now when you'll start your 100-day sales streak. Chart it on your calendar and count work days versus non-work days. It doesn't have to be 100 consecutive days; you'll need a break now and then, and you may have some other plans already on your calendar, so adjust accordingly!
    4 Rules to commit to before you accept the $100,000 in 100 Days challenge:
    A)   You will have to actively contact both people you already know as well as those you don't know.  People you know are past clients, people in your sphere of influence, and agent referrals. People you don't know are everyone else. Are you willing to speak with both to earn your $100k in 100 work days?
    B).   You should know where your business came from last year and keep doing what has worked.  Commit to doing MORE of what worked.  
    For example, if you had 5 transactions from repeat clients, but you didn't have a system to speak with your database regularly, how many more repeat clients could you create this year by being more drilled down on that source of business?
    C).   You must be willing to do what you don't want to do when you don't want to do it at the highest level. Keep doing what you're doing, and you'll keep getting what you're getting. If you want more, faster, if you want to go to the next level financially, you must go to the next level with your skills, discipline, and consistency.

    What if your seller/buyer is being more proactive than you are?

    TOP FIVE SOLUTIONS to turn Would-Be Sellers into LISTINGS!
    1 Consider building a home instead of chasing after the scarce resale inventory.  There are several advantages to this option.  First, many builders are buying down interest rates using their in-house financing.  The buyer can lock in a better rate this way.  Next, the house is new.  No rehab for them and no inspection woes for you.  Your client can get their home on the market a few months before completion and not have to move twice.  Finally, when your client builds, they aren’t having to compete in a bidding war.  Builders with in-house financing also have superior mortgage interest rates.  (In a 7+% interest rate environment, Toll Brothers has a 5.8% 30-year fixed rate program this week!)
    2 Consider buying first, closing, and then listing the previous home.  Don’t assume your buyer/seller prospects won’t or can’t utilize this option.  They may have a downpayment saved that isn’t their home equity.  They might use a bridge loan to borrow their equity, close on the next home, and then sell the old one.  You don’t know if you don’t ask.  The advantage is that your client can make a non-contingent offer, secure their next home, and deal with their old house later. Make sure you know lenders who offer bridge loans and that you understand how to explain this option.
    3 Consider selling first, renting for a while, and taking the time to look for the right home.  The advantage here is the seller has cashed out their equity and is ready to pounce on the right home, but without the pressure of organizing closing and possession dates.  Who are your go-to leasing agents?  Consider both traditional rentals, short-term vacation rentals that may consider a lease, and apartment complexes.

    What's the bottom line? You can't just wait around for listings to appear for your seller prospects who have to buy!  Be proactive with different solutions that could work for them.  You'll have more transactions, and they'll value your expertise, netting you both current business and future repeat referrals.

    6.  You DO have to be transparent and very specific about the compensation part of your agreement!  
    As per the proposed settlement, any compensation received by an agent or broker must be clearly specified in the written agreement with the buyer.
    The agreement must outline the exact amount or rate of compensation to be received or provide a method for determining this amount. However, the compensation must be "objectively ascertainable" and cannot be left open-ended.
    For instance, stating "buyer broker compensation shall be whatever amount the seller is offering to the buyer" is not permissible under the settlement terms. (Don't be lazy and try to use this as a catch-all phrase). It won't fly.

    Furthermore, the settlement stipulates that the compensation received by an agent or broker for brokerage services cannot exceed the agreed-upon amount or rate outlined in the buyer agreement. This means that if your agreement specifies that you're charging $1500 flat fee, but the listing your buyer wants has a 3% buyer commission included, you still make just the $1500.

    It's important to note that brokerages are not restricted to having only one agreement with a buyer.
    The Frequently Asked Questions (FAQ) section clarifies that NAR policy does not dictate the components of a contract. The FAQ emphasizes that compensation remains negotiable and should be discussed and agreed upon between MLS participants and the buyers they represent.

    6.  How long do agents have to make these changes?
    -Until August 17th
    7.  Who will be enforcing the changes?
    -Individual MLSs are responsible for enforcing these rules.
    8.  What about buyer clients and seller clients and our existing agreements through the transition?
    -Local MLSs will require either new contracts or amendments by August 17th. Pay attention to what's being required and make sure you're compliant.
    8.  What should you do NOW in anticipation of these requirements?

    1.  What are the policy changes resulting from the commission lawsuit settlements?
    a) Compensation offers in the MLS between listing brokers or sellers to buyer brokers or other buyer representatives are now either eliminated or prohibited.
    b) MLS is required to eliminate broker compensation fields in the MLS.
    c) MLSs are required NOT to create, facilitate, or support any non-MLS mechanisms for participants, subscribers, or sellers to make offers of compensation to buyer brokers.

    (This includes providing listing information to an internet aggregator's website, for example)
    d) MLS participants must not, and MLSs must not enable the ability to filter out or restrict listings based on the level of compensation offered.  No searching for the best commissions! 
    e) Compensation disclosures are required for sellers as well as for prospective sellers and buyers.

    2.  What does 'Working with a buyer' actually mean?  This depends on the situation.  For example:
    According to NAR's FAQs on this, simply marketing your services to a buyer or speaking to a buyer on the seller's behalf (let's say you have a listing and a buyer comes to your open house) does NOT mean that you are 'working with a buyer' based on the settlement agreement.
    When are you considered to be 'working with a buyer'?
    When you provide actual services to a buyer, such as searching for homes for them, setting up showings, negotiating, providing CMAs, or presenting offers.
    3.  What about Dual Agency?  NAR has stated that "Agency is a matter of state law, including how the dual agency is defined, what disclosures are required, and if it's deemed lawful for consumers in that state."  
    Dual Agency is not created when a listing broker simply answers a buyer's questions or shows the home to an unrepresented buyer.
    This is a sticky topic, so we defer to your state law on this one!  It's also worth noting that you may be in a state that allows Dual Agency, but your BROKER or team may disallow dual agency.  Adjust accordingly and keep your facts straight on this topic!

Know these facts when speaking with the public about what is truly going on in the housing market. This is an election year and that means the fear and loathing over the economy, housing market, interest rates and inflation, social issues will only intensify.     Here are the facts. 
    *Inventory rose again, albeit modestly, from 556,000 listings to 560,000 actives.
    *The same week last year, inventory actually fell from 421,000 to 420,000.

    *For context, the all-time low (ever!) was only 240,000 active listings in 2022. And for more context, pre-COVID, pre-COVID Boom, in 2015, listings were at 1,081,000.
    *Where are you finding inventory for your buyers?  
    *33% of listings have at least one price reduction before selling.
    *All in all, the total number of homes active for sale is up 30%.  That's 6 straight months of inventory growth.
    *The median home price is slightly up from last year, at $430,000.

    *Nationwide, the average days on the market are 47.  
    From NAR this week:
    National Association of Realtors® Chief Economist Lawrence Yun forecasts that interest rates will fall in the long term, 2024 existing-home sales will rise to 4.46 million (up 9% from 4.09 million in 2023), and 2025 existing-home sales will increase to 5.05 million (up 13.2% from 2024).
    Yun also explained that rents will calm down further, which will hold down the consumer price index (CPI) and make the Federal Reserve cut interest rates.
    Yun said that based on April's employment data, there are six million more jobs compared to the pre-Covid highs, and jobs are boosting home prices.

    1.     "I assume because you're calling/emailing/texting me directly, you're not already working with another agent?" This question happens early in the script, so you can skip the rest of the script if they're already committed to another Realtor.
    2.     "What price has your lender told you NOT to go above?"  This question covers all of the bases with regard to finding out about their financing.  When you ask this question, they'll tell you if they're all cash.  They'll tell you that they haven't got a lender yet, they'll tell you if they're pre-approved, and what price not to go over.  Instead of asking all those individual questions, the script "What price has your lender told you not to go above?" gets straight to the answer.

    3.     "Which home in the neighborhood do you plan on selling?"  This helps you determine if they are also listing leads!  Note: many agents never ask this question when they get buyer leads. Don't make this mistake! Many buyer leads are listing leads in disguise.

    7.     Connect with Assisted Living Care housing intake directors.  Most people pay for their assisted care living costs by selling their homes and cashing out the equity.  The housing intake coordinators are a great source of those leads.  Provide value by being a liaison between the homeowner and the director, and the director will love you!  Modify your Pre Listing Package to include contacts for estate sale specialists, pet rescue, moving and storage, etc.
    8.     Find the Notice of Defaults.  Search the zip codes your buyers are looking for for  NODs and see if the homes fit your buyer's criteria.  These are not usually listed, but they are usually motivated!
    9.     Mine your own database (your past clients and people in your sphere of influence) as 'shadow inventory'.  Who owns a home currently that may be a match for your qualified and motivated buyers?  This creates two to three transactions for you.  
    10.     Call 100% of your database to see who is curious about what their home is now worth in today's market.  If they knew their home is now worth ____, what would that do to their plans?
    11.     Search your neighborhoods for 'half-done flips'.  The cost of building materials and labor has increased dramatically.  Which flippers are feeling the pinch?  Certain buyers may be willing to purchase the home and finish it themselves or at least get into a contract pending the finishing of the project.  
    12.     Condo or apartment conversions.  There are still new or newer neighborhoods or buildings that have been rentals but are now becoming resales.  
    13.  Expired listings... recent expireds and older expireds. You probably CAN get them their price in today's market. Offer to provide a new comparative market analysis and see what that does to their plans.

    14.     For Sale By Owners (unrepresented sellers), especially if they have been on the market for more than two weeks and still haven't sold.
    15.     Absentee owners.  RE-InvestorList.com and other companies provide this information.  Get the address, make sure it's not already listed, and connect with the owners to see their plan for the property.  Offer a free CMA to help them decide!
    16.     Vacation Rentals (VRBOs). Look at the rental history and pursue property owners who own homes in the areas you or your buyers want to see if they would consider selling. Their phone numbers and email addresses are almost always listed online. Many VRBOs are experiencing new rules that limit their rental options, thus reducing their profitability.

  • Where's all the inventory?  Yes, it's growing, but it's also all selling nearly immediately.  There are buyers who are all cash, loan-committed, or at least pre-approved, anxiously waiting for you to get them what they want ASAP.

    Before we get to the secret sources and strategies, here are some thoughts to consider:
    1.     How well do you know what your buyers are actually looking for?  Are they (or you) being too specific or overly obsessed with certain areas, amenities, or schools?   It may be time to discuss having some flexibility.  Know your buyer client's 'must have' versus 'would be nice to have' criteria.
    2.     Stop relying only on your MLS.  This is one method but is no longer THE method.

    Commit to following these strategies for every qualified and motivated buyer (especially those who also have listings to sell), or simply refer them to an agent who will do a better job for them. It's not fair for buyers to not be in contract simply because you haven't been strategic enough to find them something!
    The goal of the following strategies is to:
    -Find off-market homes for you to list.
    -Find off-market homes to sell to your buyers so they no longer lose out to competition. If you want to stop competing (and losing), you MUST find homes they're unlikely to compete on!

    Now for your 20 Strategies to find off-market or hidden listings:
    1.     Get more creative with your MLS searches.  If your buyers keep losing out to multiple bids, search your MLS using the same criteria but for homes that have been on the market for more than 60 days, more than 90 days, etc.  They probably won't be competing for those homes.  Maybe they would consider a duplex in the same area, especially if it provides income for them.  Have you had these conversations?
    2.     Expand the search for your buyers geographically.  If they say they want 'these three zip codes in Austin,' for example, identify WHY those zip codes and find other areas that have more inventory but feel similar to those zip codes.  Same for school districts, amenities, etc.  Maybe they just like the neighborhood park in that neighborhood, but there's a BETTER one 10 miles away.

    1.  Coaching clients report that there are far more expired listing opportunities than they thought.  Key changes they made to find more expired homes?  Expand your geographic search, go further back in time, and add withdrawn and temporarily off-the-market homes.  Call your MLS if you’re unclear on how to perform these searches, or get help from your broker.

    2.  Coaching clients state that the owners of expired listings are way nicer to talk to and much more open to discussion than they thought.  They are craving a new approach and a better strategy.
    3.  Coaching clients who are taking these listings often sell them within 10 days or fewer of taking them. This creates a fantastic marketing opportunity to prospect even more expired owners. Client testimonials can be utilized for videos, postcards, door hangars, etc.

    Top Complaints Expired Sellers have about their previous agents (Real-world commentary, as reported by coaching clients): 
    1.  The previous agent took the listing, put it in the MLS, and did nothing else. They expected the home to sell itself, which suggests a sense of overpromising and underdelivering.
    2.  The previous agent didn't do any open houses.  The previous agent either said they didn’t work, they didn’t believe in them, or they were unnecessary.  This really makes sellers mad. Open houses are one of the only tangible things sellers see agents do.

    3.  The previous agent's pictures were horrible. They were seen in the mirror, showed open toilet lids, too dark, not staged, and not professionally shot. The sellers were disappointed in the lack of effort.
    4.  A Seller was away from the home and returned to roaches in the foyer.  No one was checking on their vacant home.  In this case, the home didn’t expire; the seller just fired the agent. It was showing as ‘withdrawn’.
    5.  Sellers often complain of zero or poor communication from their previous listing agent. Our coaching clients have a communications guarantee as part of the Pre-Listing Package. Problem solved!
    6.  Some sellers state that the only time they heard from their agent was to ask for a price reduction.  While price reductions are often needed, you’re less likely to get one if you’re not showing value before you ask for the reduction!

    The daily success schedule of top-producing agents is all about having daily minimum standards related directly to profit and being relentless about them.  Today we'll show you what they do, so you can follow the same plan and find success faster!
    1.     Use and update your Visual Accountability White Boards every day.  You should be tracking all of the following, based on your goals:  (Use the Real Estate Treasure Map).
    -Leads.    -Active Listings.   -Buyers.     -Pending closings.    -Closed transactions.

    2.     Review your finances every day.  Use Mint.com as your 'dashboard' of Key Performance Indicators or KPI's.  Your savings, checking, credit cards, investment accounts, investment properties, and everything else financial is visible using Mint.com. This includes your credit scores as well as your upcoming bills and actual budget.

    3.     Make contact (a conversation with a decision-making adult about real estate) with at least the same number of people as transactions you must do this year.  If you must close 20 transactions to meet or exceed your goals this year, you must make 20 actual contacts daily to meet that goal.  Adjust as your skills increase.  Focus on people who are most likely to sell.  Example:  Existing listing leads you just need to close on, expireds, for sale by owners, probate, relocation, past clients and referrals.  Just listed and Just Sold calls don't count unless they are directly around your own listing(s).

    4.     Furiously fast lead follow-up on 100% of your leads, 100% of the time, no exceptions or excuses.  If you're a Premier Coaching member, review 18 Relentless Lead Follow-Up Rules.
    5.     Show gratitude overtly to those you care about.  Start your day out right saying I love you and giving hugs and kisses.  Then write and send at least 3 thank you or congratulations cards to past clients or people in your sphere of influence.  Use social media for ideas about who got a promotion or had a kid get married or graduate.  
    6.     Set a new, prequalified appointment before noon every work day, ideally with sellers.  When you're doing #4 (Furiously Fast Lead Follow-Up), this will be much easier to achieve.  If you don't have enough leads to set appointments regularly, go back to #3 on this plan.
    7.     Doorknock or call at least one Unrepresented Seller (FSBO) each day.  You sell real estate for a living.  They have a home to sell.  Their phone number is on their sign!

    2 February:  Use Red Hot candies for a pop-by gift, ‘It might be cold outside, but the market is red hot!’  Or ‘I love referral business!’  Using heart candy or heart candles. You can use these for doorknocking, lead follow-up, open house giveaways, and at the closing table.  Bring them to new build reps and ask for their resale referrals.
    3 Spring:  Tax time, free CMAs, and closing statements to last year’s clients. You can do one video email offering an updated market analysis and follow up with phone contact.
    4 Spring: ‘Buy or Sell With me / Adopt A Pet For Free’ promotion.  Work with your ASPCA or local shelter for a specific format. They often promote this to you with press releases or events like PetSmart adoption days.  Promote your event via video sent to your database, individual phone calls to invite your people, and of course, post on social media.  Note: Press releases are easy to get published. This is the type of event that gets a lot of media attention.

    5 May:  Memorial Day Parades, especially if you’re in a military or historic town.  Participate in existing parades, and give out candy water bottles or American flags.  Create a Facebook live session or a video about VA loans and how they work.  Doorknock your neighborhood and doorknock prior to your open houses with red, white, and blue candy and flags.
    6 June: Paper ‘n Pancakes Paper Shredding Party! Rent a shredding truck and a pancake food truck and host a shredding party at your office or at an events center or clubhouse. This has a surprising turnout and doesn’t cost much!
    7 Summer Tornado / Hurricane / Fire season.  After a disaster, host a donation drive. You can do this doorknocking, or ask people to drop donations at your office or home office.  Get good press for this through your local papers and TV stations.
    8 Summer / Fall:  Work with the American Red Cross for a blood drive. They’ll bring the BloodMobile to your location and even prospect for you so you have maximum turnout.
